In case of sale to a professional, a delay of payment can be granted by Champagne Breton Fils, in the limits prescribed by the law of 1rst July, 1996, and will be mentioned in the quotation.
In the absence of a particular specification added to the actual conditions and agreed on paper, the orders are subject to these general sales terms and conditions with no regards to the documents of the buyer.
In case of sale to a professional, an established quotation is valid for 30 days, as from the date of creation of the document. It should be returned by fax by the buyer, duly dressed, and will have to be signed, the mention "read and approved" must be added and the stamp of the company must be affix on the quotation. This acceptation of the order will mean acceptation of the general selling terms and conditions.
The order is prepared when CHAMPAGNE BRETON FILS has received the totality of the payment and the integrality of the required elements to the agreement fulfillment.
By elements we mean:
- Return of the quotation by fax (as mentioned in point 1).
- Specific address of billing, name of the contact and telephone number.
- Specific address of delivery and telephone number of the beneficiary. His or Her address and phone number would have been verified and update by the ordering party.
If the integrality of the delivery address is not received, the order will not be prepared. In this particular case, delays of delivery should not be opposed to Champagne Breton Fils. If all or part of the delivery address is not correct, forcing Champagne Breton Fils to return the order to its warehouse, the buyer will support the consequences. Besides, Champagne Breton Fils will invoice the administrative and transport costs associated to the order return to the buyer.
Champagne Breton Fils can deliver in France and abroad. The delay of delivery depend on the place of delivery, we will forward the goods on receipt of the payment
If the ordered wine is out of stock, Champagne Breton Fils will inform the client as soon as possible. In agreement with the client, Champagne Breton fils can modify the order, for example with the vintage of the year following or with an equivalent wine or can also reimburse the value of the product.
The prices mentioned in the quotation are agreed all taxes included for France. It includes the VAT, exercise duty and all other taxes. Shipping costs are to be paid by customers. For the foreign countries, prices are without taxes, shipping costs are also invoiced.
Champagne Breton Fils reserves the right to modify its price at any moments. Of course, the products ordered are charged at the effective price during the order.

In case of sale to a professional, in application of the article L 441-16 in the commerce code, penalty of delay are due the day following the date of payment figuring on the invoice in case of the total due are paid after this date. The rate of penalty is one time and a half the legal interest rate.
In application of the article L.121-16 of the consumption code, the buyer can return the article within 7 days from the receipt of the delivery. He or she can be reimbursed or can proceed to an exchange, at consumer's will, without any penalty with the exception of the shipping.
The client will have to inform Champagne Breton Fils by mail before returning his or her goods.
The return shipping costs are at the client's expenses. He or She can decides to return the products own means or can ask Breton Fils to organize this return for him or her. The value of the products can be reimbursed within 1 to 3 weeks. There is no return possible for the goods sent overseas.
The products characteristics suggested to be sold as described on the description files of Champagne Breton Fils. The pictures do not enter into the contractual field. The responsibility of Champagne Breton Fils cannot be engaged if mistakes entered.
The products are proposed to be sold until they are sold out. In case the product you ordered is sold out, Champagne Breton fils can modify the order, for example with the vintage of the year following or with an equivalent wine or also reimburse the value of the product in accordance with the customer's will.
The delivered products are the property of Champagne Breton Fils until the totality of their payments, in accordance with the terms of the law n°80 33 6 of 1st may, 1980, relative to the title retention clause.
Champagne Breton Fil is required to have legal guarantee regarding the latent defects, as it is defined in the article 1641 and so on in the civil code that arrange:
"The seller must guarantee the latent defects of the thing that make it unsuitable for the use it was intended or which diminish the use that the buyer would not have acquired, or would have given a lower price if he had known." Consequently, the buyer has up to 2 months (from date of delivery) to send the complaint to Champagne Breton Fils. Beyond this period, the Champagne Breton fils company can no longer guarantee the wine, since no control over the quality of the storage (essential to the preservation of wine) can be performed, or the buyer must provide proof the alteration of wine is prior to the sale.
- If the ordered products break and are followed by a stockout, Champagne Breton fils would offer to the buyer a product of equal or superior quality and the conditions of sale will not be affected (particularly in terms of price ).
The information collected by Champagne Breton Fils may be the subject of external communication except in cases of refusal of the client. The disclosure of such information may also be made to meet legal and regulatory obligations. Pursuant to Article 27 of Law No. 78-17 of January 6, 1978, relating to data, files and freedoms, the information may give rise to the right of access to Champagne Breton Fils.
These general conditions of sale are subject to the application of French law. Contractual informations are presented in French and English; Products offered for sale are in accordance with French law. The court's headquarters Breton Fils Champagne has exclusive jurisdiction over any disputes arising from the application of these general conditions of sales, excluding any referral by Champagne Breton fils to another jurisdiction.
Pursuant to Article L. 3342-1 Code of Public Health which states that the sale of alcohol to minors under eighteen (18) years is prohibited, the buyer agrees, filling the order, to have eighteen (18) years of age at the time of the order.
